Privacy policy

This translation is provided for convenience. In the event of any discrepancy, the Spanish version shall prevail.
This policy explains what personal data BAYGAR S.L. processes through this website, why, on what legal basis, for how long, and what your rights are.

2. What data we process and why
Contact form
- Data: your name, email address, phone number (if you provide it), branch (if you choose one) and the text of your message.
- Purpose: to reply to your enquiry and, if you ask us to, to prepare a quotation or a sale or hire proposal.
- Legal basis: taking steps at your request prior to entering into a contract (Article 6(1)(b) GDPR) when you ask about products, prices or terms; and Baygar’s legitimate interest in responding to the enquiries it receives (Article 6(1)(f) GDPR) in all other cases. We do not rely on your consent, which is why there is no tick box.
- Marketing: we will not send you advertising because you have used the form.
- Required fields: your name, email address and message are needed for us to reply. Everything else is optional.
Website security and abuse prevention
- Data: a pseudonymised IP address (a code that changes every day; without the server’s secret key it is not possible to tell which IP address it corresponds to), the date and time, and the technical outcome of the submission (for example, “sent” or “too many attempts”). The content of messages is not stored on the web server.
- Purpose: to protect the form against automated submissions and attacks, and to limit how often messages can be sent.
- Legal basis: legitimate interest in ensuring network and information security (Article 6(1)(f) and Recital 49 GDPR).
Anti-abuse filters may automatically discard or limit a submission. No decisions with legal effects concerning you are taken: if a message does not get through, you can contact us by phone or email.
Visit statistics
- Data: pages visited, date and time, referring page, browser and device type, language and IP address, which the tool anonymises before storing it. No cookies or other identifiers stored on your device are used, and if your browser sends a “Do Not Track” signal your visit is not recorded.
- Purpose: to understand, in aggregate, how the website is used so that we can improve it.
- Legal basis: Baygar’s legitimate interest in understanding how its website is used (Article 6(1)(f) GDPR).
- Tool: Matomo, installed on our own server (
nubogestion.com) rather than an advertising or third-party service such as Google Analytics.
3. How long we keep your data
- Enquiries: for as long as needed to deal with them and, if they lead to a business relationship, for as long as that relationship requires. After that, they are kept blocked only for the statutory limitation periods.
- Technical security logs: 30 days, after which they are deleted automatically.
- Visit statistics: for as long as needed to compile the statistics, which are only used in aggregate.
4. Recipients
We do not share your data with third parties unless required by law. Service providers who process data on Baygar’s behalf (processors) are involved in providing the service, under contract and with appropriate safeguards:
- Email: your message is delivered to Baygar’s corporate mailbox, hosted on Microsoft 365.
- Web hosting: the provider that hosts this website.
- Statistics: the Matomo server at
nubogestion.com.
5. International transfers
Baygar does not itself transfer data internationally. If any provider were to process data outside the European Economic Area, it would do so with the safeguards set out in Chapter V GDPR, such as adequacy decisions or standard contractual clauses.
6. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability by writing to baygar@baygar.com and stating which right you wish to exercise. If necessary to verify your identity, we may ask you for additional information.
If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
7. Security
The website only works over an encrypted connection (HTTPS). The form includes measures against automated submissions and abuse. No measure removes all risk, but we keep our protection under continuous review.
8. Changes to this policy
If the way we process data changes, for example when the new website goes live, we will update this policy and show the date of the latest update.
